Legal enforcement risk has intensified in recent years, particularly through the False Claims Act (FCA). The FCA allows the government to pursue civil penalties and damages against contractors that knowingly submit false claims or certifications related to federal contracts. Enforcement has expanded to include a broad range of compliance issues, from procurement fraud to cybersecurity misrepresentations.

Recent enforcement statistics illustrate the scale of this trend. Federal authorities have recovered billions of dollars in FCA settlements in recent years, including cases involving government procurement and grant funding. This aggressive enforcement environment signals that compliance failures will be taken seriously by regulators and prosecutors.

Cybersecurity has become a major focus area for FCA enforcement. Under the federal Civil Cyber Fraud Initiative, contractors may face liability if they misrepresent their security controls, fail to disclose cyber incidents, or provide products that do not meet required security standards. This approach effectively transforms cybersecurity compliance into a legal risk management issue.

Whistleblower activity further increases exposure for contractors. Employees, competitors, or subcontractors can file FCA lawsuits on behalf of the government if they believe fraud or misrepresentation has occurred. As a result, contractors must establish strong internal compliance programs and encourage employees to report concerns internally before issues escalate into legal actions.

NAGC is working to reduce compliance risk by educating contractors on federal procurement laws and promoting strong internal compliance practices. NAGC is developing guidance materials and training sessions that explain the legal risks associated with certifications, billing practices, and regulatory compliance under federal contracts. NAGC is also encouraging contractors to establish internal reporting channels and compliance monitoring programs that can identify issues before they escalate into legal actions. Through advocacy efforts and collaboration with policymakers, NAGC is supporting fair enforcement policies that protect taxpayer interests while ensuring that contractors have clear guidance on how to comply with federal requirements.
